Diversified Consultants, Inc. is on the receiving end of a proposed class action lawsuit alleging that it sent a New York consumer a misleading collection letter in violation of the Fair Debt Collection Practices Act.
Diversified Consultants, Inc. is on the receiving end of a proposed class action lawsuit alleging that it sent a New York consumer a misleading collection letter in violation of the Fair Debt Collection Practices Act (FDCPA). The plaintiff in the case claims she received a collection notice from the defendant that stated her “Current Balance” as $656.31 and “Total Non-Interest Charges or Fees Since Charge-Off” as $100.11. The suit argues that the letter unlawfully failed to mention, however, whether the plaintiff’s balance would continue to increase or stay the same, despite listing the extra charges that have been added to it. As a result, the complaint claims, the plaintiff is left uncertain as to how much she allegedly owes at any given time and how much she would need to pay to settle the account.
