Gomez v. Graziano’s Holding, LLC
Filed: October 13, 2017 ◆§ 1:17-cv-23767-PCH
Graziano’s Holding, LLC is facing a proposed class action lawsuit claiming its website is inaccessible to blind individuals and therefore violates the Americans with Disabilities Act.
Graziano’s Holding, LLC is facing a proposed class action lawsuit claiming its website is inaccessible to blind individuals and therefore violates the Americans with Disabilities Act (ADA). The plaintiff in the case, a blind Florida man, says he attempted to access the defendant’s website – which allows users to locate Graziano’s restaurants, view the menu, obtain coupons, and learn about catering – but was met with various barriers that hindered him from fully navigating the site’s content. According to the complaint, the site contains empty links and images that are missing alternative text, as well as empty headings that fail to state the purpose of the page. Additionally, the complaint argues, the site contains no ADA statement informing visually impaired users of their rights and accessibility options, and does not allow disabled users to adjust the website’s format to make it easier for them to use. The suit insists that the defendant must only make minor changes to its website to allow for equal access – modifications that it claims are unlikely to occur “without court intervention.”
