A Wisconsin woman has filed a proposed class action lawsuit against Americollect, Inc. and The Orthopedic Institute of Wisconsin (OIW) claiming they unlawfully attempted to collect from her a medical debt purportedly owed by her husband.

A Wisconsin woman has filed a proposed class action lawsuit against Americollect, Inc. and The Orthopedic Institute of Wisconsin (OIW) claiming they unlawfully attempted to collect from her a medical debt purportedly owed by her husband. The suit alleges that neither OIW or Americollect had sued the plaintiff in order to establish her liability for paying her husband’s medical expenses, yet she says Americollect, on OIW’s behalf, sent her a collection letter seeking payment. The complaint claims the letter’s “sole purpose” was to “unduly harass” the plaintiff into paying the alleged debt, which the suit says is a violation of the federal Fair Debt Collection Practices Act and Wisconsin state law.
