Credit Control, LLC has been hit with a proposed class action out of New York federal court that claims the debt collector sent a consumer a misleading collection letter.
Credit Control, LLC has been hit with a proposed class action out of New York federal court that claims the debt collector sent a consumer a misleading collection letter. The letter allegedly contained the following statements:
“Because of interest, late charges and other charges that may be assessed by your creditor that vary from day to day, the amount due on the day you pay, may be greater. Thus, if you pay the total amount shown above, an adjustment may be necessary after we receive your check, in which event we will inform you.”
The suit argues that the above statements were misleading because the plaintiff’s creditor had written off the debt more than a year earlier and “there was no chance” that the balance would change.
