Cole Haan, LLC and Apax Partners Worldwide LLP are facing claims that they falsely advertised products sold in their outlet stores with fictitious “original” or “regular” prices. In a proposed class action lawsuit, a California consumer claims that he purchased shoes for his wife at one of the defendants’ outlet stores that were listed as 50% off the “original” price. The plaintiff says he believed the shoes were originally sold at the defendants’ retail stores and were marked down to be sold at the outlet. The suit argues that in reality, the defendants manufacture a different line of “inferior quality” products to be sold at only outlet stores and mark them with false “original” prices at which the products were never sold. According to the complaint, this practice deceives consumers into thinking they are taking advantage of a good deal and leads them to purchase products they would never have bought had they known the truth about the price and quality.
