Lawsuit Claims Weyerhaeuser ‘Flak Jacket’-Coated TJI Joists are Defective

Weyerhaeuser Co. is staring down a lawsuit filed over its TJI joists coated with Flak Jacket protection, which the case claims emits noxious, harmful gases.
From New York comes a proposed class action claiming Weyerhaeuser Company’s TJI Joists with Flak Jacket Protection are defective and responsible for damages to the plaintiffs’ and class members’ homes and other buildings. The 30-page complaint takes issue with Weyerhaeuser’s representation of the joists as having “all the quality and cost-efficiency” and extreme durability consumers have come to expect from the company’s lumber products. Contrary to these claims, the lawsuit argues the joists emit noxious and toxic gases that are harmful to humans because the products’ “Flak Jacket” coating contains a formaldehyde-based resin that causes “off-gassing of formaldehyde far in excess” of acceptable levels.
The complaint mentions short-term exposure to formaldehyde, even for as little as 15 minutes, can cause respiratory irritation, headaches, coughing, and dizziness. Long-term exposure, the case continues, has been linked to an increased risk of nose and sinus cancer, lung cancer, and leukemia, among other diseases.
“The defective nature of the joists is so severe that [the plaintiffs’] and class members’ homes and other structures are uninhabitable,” the complaint alleges. “The joists require immediate repair, removal and/or replacement.”
