USCB Corporation is facing claims that it failed to comply with the Fair Debt Collection Practices Act (FDCPA) in collection letters it sent to consumers.
USCB Corporation is facing claims that it failed to comply with the Fair Debt Collection Practices Act (FDCPA) in collection letters it sent to consumers. A proposed class action lawsuit has been filed against the debt collector by a New York woman who alleges that the defendant failed to clearly identify her creditor in a collection letter. The letter supposedly listed the “original creditor” as “US Career Institute” and “current creditor” as “USCB Corporation.” The letter then stated, “At this time your collection account with US Career Institute remains unpaid,” according to the complaint. The suit argues that the letter is considered misleading under the FDCPA because its “inconsistent” statements leave the unsophisticated consumer unsure as to whether US Career Institute or USCB Corporation is the creditor to whom the debt is owed.
