Barcel USA, LLC is facing a proposed class action that claims the food manufacturer underfills its 4.0-ounce Takis Rolled Tortilla Chips packages.
Barcel USA, LLC is facing a proposed class action that claims the food manufacturer deceptively packages its 4.0-ounce Takis Rolled Tortilla Chips. According to the suit, the bags contain mostly air, or “non-functional slack-fill,” which the complaint describes as empty space that “serves no legitimate purpose” and “misleads consumers about the quantity of food they are purchasing.” The plaintiff says the bags of chips she purchased contained approximately 64 percent slack-fill, causing her to overpay about $0.69 per bag. The suit goes on to compare the defendant’s products with similarly sized competitor products that allegedly contain significantly less slack-fill, proving, according to the complaint, that the amount of air in each bag the defendant fills is not justified for any functional reason.
“[The plaintiff and proposed class members] reasonably relied on the size of the Product’s packaging to infer how much food they were purchasing,” the complaint reads, “and reasonably believed that the bags were filled as closely to capacity as functionally possible.”
