RSI Enterprises, Inc. is on the receiving end of a proposed class action filed by two Wisconsin roommates alleging it unlawfully placed two calls to one plaintiff’s cell phone regarding a supposed debt owed by the other.

RSI Enterprises, Inc. is on the receiving end of a proposed class action that alleges violations of the Telephone Consumer Protection Act (TCPA) and the Fair Debt Collection Practices Act (FDCPA). According to the complaint, the two named plaintiffs are roommates who are neither married nor related, yet the defendant allegedly placed two calls to one plaintiff’s cell phone regarding a supposed debt owed by the other. The suit claims the calls were placed without prior consent using an automated dialing service in violation of the TCPA.
The complaint further argues that defendant was not permitted under the FDCPA to disclose information about a consumer’s debt to a third-party, noting that the alleged debtor’s roommate “had no interest in” her debt. Additionally, the case claims one of the calls referenced a “pending civil matter,” which it argues is misleading to the unsophisticated consumer because the defendant is an out-of-state debt collector that has no authority to sue the plaintiff.
