Gonzales v. Peter Thomas Roth Labs, LLC
Filed: August 14, 2017 ◆§ 8:17-cv-01393
A proposed class action alleges the company deceptively packages its Rose Stem Cell Bio-Repair Precious Cream in violation of California law.
Peter Thomas Roth Labs, LLC is the defendant in a proposed class action that alleges the company’s Rose Stem Cell Bio-Repair Precious Cream is intentionally packaged in opaque containers that “contain a false bottom and a false top” to conceal from consumers the actual volume of the product. The lawsuit alleges the amount of product consumers receive is a “small fraction of the exterior volume of the container,” and goes so far as to say said containers are “essentially empty.”
The below images of the product’s packaging are included in the complaint (not included in the complaint is a picture of the product inside its opaque container):
“The is no functional reason for including false bottoms and false tops in the product packaging,” the lawsuit argues.
The complaint cites alleged violations of California’s Fair Packaging and Labeling Act, the goal of which, the lawsuit cites, is to “enable consumers to obtain accurate information as to the quantity of the contents and should facilitate value comparisons.”
