Colon v. Northstar Location Services, LLC
Filed: April 6, 2017 ◆§ 2:17-cv-02025
A proposed class action lawsuit has been filed against Northstar Location Services, LLC that claims the debt collector used 'a false, deceptive and misleading' letter.
New York
A proposed class action lawsuit has been filed against Northstar Location Services, LLC that claims the debt collector used “a false, deceptive and misleading representation in its attempt to collect a debt.” The plaintiff alleges that he received a collection letter from the defendant that included “Total Fees Accrued Since Charge-Off,” which were listed as “$0.00.” This statement, the suit argues, can mislead the unsophisticated consumer into believing the defendant has the right to charge additional fees if no payments are made on the debt. According to the complaint, the “Total Fees” statement is deceptive because Northstar “has no legal basis to add a fee to the debt.” The statement was included in the collection letter to “threaten” the consumer into paying off the alleged debt, the suit claims.
