A proposed class action filed against Mosex Exhibit 1, which operates the Museum of Sex, claims the company's website discriminates against blind users.
A New York law firm familiar with filing cases over alleged Americans with Disabilities Act (ADA) violations has brought a proposed class action against Mosex Exhibit 1, LLC, the operating company behind The Museum of Sex, alleging the company’s website—Museumofsex.com—unlawfully discriminates against blind and visually impaired users.
The 26-page lawsuit claims the plaintiff attempted to access the defendant’s website to purchase Province Apothecary Lover’s Oil, yet was unable to so due to accessibility barriers that prevent the use of assistive technology utilized on other heavily trafficked retail websites.
“Museumofsex.com contains access barriers that prevent free and full use by [the plaintiff] and blind persons using keyboards and screen reading software,” the lawsuit alleges. “These barriers are pervasive and include, but are not limited to: lack of alt-text on graphics, inaccessible pop-up windows, the lack of adequate prompting and labeling, the lack of navigation links; the denial of keyboard access; and the requirement that transactions be performed solely with a mouse.”
