In a proposed class action lawsuit filed in Florida, Telehealth provider MDLive, Inc. is facing allegations that it illegally discloses consumers' sensitive health data.
In a proposed class action lawsuit filed in Florida, Telehealth provider MDLive, Inc. is facing allegations that it illegally discloses consumers’ sensitive health information to its employees and a third party. MDLive allegedly offers healthcare services to consumers through an application that allows them to virtually connect with healthcare providers, claiming users can begin a virtual consultation “within 15 minutes” of registering. What the defendant fails to disclose is that the app takes an average of 60 screenshots while users enter their sensitive medical history and health conditions during the first 15 minutes of use, according to the suit. The screenshots are supposedly sent to TestFairy, an Israel-based tech company that uses them to test user interaction and check for bugs. From the complaint:
“Patients provide their medical information to MDLive in order to obtain healthcare services and reasonably expect that MDLive will use adequate security measures, including encryption and restricted permissions, to transmit patients’ medical information to treating physicians. Contrary to those expectations, MDLive fails to adequately restrict access to patients’ medical information and instead grants unnecessary and broad permissions to its employees, agents, and third parties.”
