Lawsuit Claims Makers of Sea-Doo Watercraft Hid Alleged Exhaust Defect

Two plaintiffs claim in a proposed class action lawsuit that the makers of Sea-Doo personal wartercraft intentionally concealed an dangerous exhaust system defect.
Two plaintiffs claim in a proposed class action lawsuit that defendants BRP US, Inc., Bombardier Recreational Products, Inc. and BRP, Inc. are responsible for an alleged exhaust system defect found in certain Sea-Doo personal watercraft. The 31-page complaint alleges the exhaust resonators found in some Sea-Doos made between 2010 and 2016 can melt and lead the watercraft to take on water. Moreover, the case claims that although the alleged defect is covered under the defendants’ limited warranty, the companies have failed to repair the alleged faulty exhaust systems under applicable warranties.
“[The defendants] are aware of the exhaust resonator defect and know that consumers do not anticipate that the class personal watercraft exhaust system has a component that will melt under normal use and result in the [watercraft] taking on water and sinking,” the plaintiffs allege. “Nevertheless, [the defendants] have not informed current owners about the exhaust resonator defect, have not disclosed the exhaust resonator defect to prospective purchasers, and continue to promote the class [personal watercraft] as safe.”
On top of allegations that the defendants knowingly hid a potentially fatal defect from consumers, the case claims the price of repairing the faulty Sea-Doo exhaust systems “can be exorbitant,” costing owners hundreds, even thousands of dollars—without taking into account the cost of any water damage.
