Keeler Instruments, Inc. – a company that sells medical equipment – is on the receiving end of a lawsuit that claims the defendant sent unlawful junk faxes.
Keeler Instruments, Inc. – a company that sells medical equipment – is on the receiving end of a proposed class action out of California federal court that claims the defendant sent junk faxes to unwilling recipients.
The suit takes issue with a fax advertisement sent to the plaintiff in July 2018. According to the complaint, the allegedly unsolicited fax included an advertisement for eye drops, and lacked a proper opt-out notice as required by the TCPA. The defendant sent unlawful fax advertisements to at least 40 other people, the lawsuit alleges. In addition to statutory damages, the proposed class action seeks injunctive relief to stop the defendant from sending "TCPA-violating" faxes in the future.
