A disabled woman has filed a proposed class action lawsuit against Unum Group Corporation and Athene Annuity & Life Company, alleging that they unlawfully demanded money.
A disabled woman has filed a proposed class action lawsuit in Florida against Unum Group Corporation and Athene Annuity & Life Company, alleging that they unlawfully attempted to recalculate her disability payments and demanded repayment of thousands of dollars. She claims that a detailed assessment of her income and living situation was made by Indianapolis Life when she originally applied for disability, and that the defendants inherited the resulting contract after a series of acquisitions and mergers. According to the lawsuit, the plaintiff began working part-time, but her salary did not break any threshold that would require a recalculation of her monthly disability payments. However, Unum and Athene allegedly reassessed her situation using a different formula and demanded that she repay them $58,014. She argues that the defendants are bound by the original contract and that their attempt to collect “overpayments” from her is illegal under state and federal law.
