A consumer says Global Credit & Collection Corp. intentionally failed to disclose that payment on a time-barred debt would reset its statute of limitations.
Illinois
An Illinois consumer is behind a proposed class action suit against Global Credit & Collection Corp. in which she alleges the company tried to collect a debt for which the statute of limitations had run out. The lawsuit alleges a letter sent by the defendant to the plaintiff is deceptive and misleading under the Fair Debt Collection Practices Act (FDCPA) because it does not advise the woman that if she were to make a payment on the obligation, the statute of limitations would restart and possibly expose her to litigation.
“The letter puts [the plaintiff] at an imminent risk of harm because if she makes payment on the debt, [the defendant] could once again sue her for the debt,” the case says.
