Lawsuit Claims Freedom Home Offers Placed Unlawful Prerecorded Calls to Consumers’ Cell Phones

Freedom Home Offers faces a lawsuit that claims it placed automated calls to consumers’ cell phones without obtaining their prior express consent to be contacted.
Freedom Home Offers faces a proposed class action in which the real estate investment company is accused of placing automated calls to consumers’ cell phones without obtaining their prior express consent to be contacted.
Per the case, the defendant has violated the Telephone Consumer Protection Act, a law that prohibits entities from using an automatic telephone dialing system or prerecorded voice to place telemarketing calls unless they first obtain the recipients’ permission.
The plaintiff, an Indianapolis, Indiana resident, says he received both a text and call from Freedom Home Offers despite not having “any existing business relationship” with the company or providing his consent to receive the telemarketing messages.
Per the case, the plaintiff received the following April 2021 text from the phone number 833-303-1082:
The plaintiff says the voicemail message that plays when the number is dialed identifies an employee of the defendant.
One day after receiving the text, the plaintiff got a call from the phone number 317- 953-0018, after which the caller left a voicemail identifying herself as “Amy” and stating that she was looking to purchase a home for cash and that she was not a realtor. According to the suit, the message was “very similar” to several messages listed in online complaints that other consumers claimed to have received from the same phone number.
The lawsuit claims the call violated the TCPA in that the defendant did not obtain the plaintiff’s prior consent “to contact him in any way” before placing a prerecorded call to his cell phone.
