On April 26, 2024, Ford and the plaintiffs notified the court that they had reached a deal in principle to resolve their dispute and were working to finalize a settlement agreement. No other details of the deal are available at this time, but the plaintiffs intend to provide a status update by May 24, 2024.

News of the deal comes just weeks after the lawsuit went to trial on March 11, 2024, which concluded about nine days later with the jury ruling in favor of Ford. In a March 20 verdict, the jury found that the automaker did not engage in deceptive practices that caused the plaintiffs to lose money.

Ford Motor Company, maker of the “iconic” Shelby GT350 Mustang, faces a proposed class action claiming the 2016 Base and Technology Package models of “Ford’s flagship race car” suffer an alleged defect that causes them to perform poorly on the racetrack. The complaint claims the vehicles were marketed as “Track-Ready,” but drivers are allegedly finding that the vehicle’s transmission and rear differential overheats after 15 minutes or less on the track, severely limiting the car’s performance and endangering its drivers. The complaint claims Ford offers no remedy for the alleged defect except to recommend expensive alterations at the owner’s expense. Plaintiffs further argue that the vehicles are unable to “withstand the demands of track racing,” for which Shelby Mustangs have been marketed since 1967, according to the complaint. The suit seeks relief for people in the U.S. who are current or former owners or lessees of the Ford 2016 Shelby GT350 Mustang with a Base or Technology Package. Three other subclasses have been proposed for people who purchased or leased the vehicles in Florida, California, or Texas.
