A consumer claims eVerifile.com submitted a background report to his prospective employer that contained inaccurate information, causing the man to lose his job.
A Nevada man claims in a proposed class action that defendant E-Verifile.com, Inc. violated federal law when it published incomplete, inaccurate and/or out-of-date information about him in an employment background check. The lawsuit, which alleges violations of the Fair Credit Reporting Act (FCRA), claims the defendant’s conduct caused the plaintiff to lose his job and suffer emotional distress.
The plaintiff says he applied and later accepted an offer for an engineering job in early 2017 for which, the case notes, he would’ve been paid more than $80,000 annually. When the man’s new employer ordered a background report on him through the defendant, the lawsuit claims the company, without providing mandatory prior notice, furnished a report that contained adverse public record information. Roughly a month after accepting the employment offer, the plaintiff claims he was informed he did not pass the mandatory background check, and that the company could therefore not more forward with his employment.
According to the complaint, the plaintiff’s background report erroneously included that he was convicted of two felonies in 2013. The plaintiff argues that upon calling the defendant to address the inaccuracies, the company informed him the information was obtained from the “respective courthouses.”
