Enhanced Recovery Company (ERC) is on the receiving end of a proposed class action lawsuit that claims the debt collector didn’t clearly identify a consumer’s creditor in a collection notice.

Enhanced Recovery Company (ERC) is on the receiving end of a proposed class action lawsuit that claims the debt collector didn’t clearly identify a consumer’s creditor in a collection notice. According to the case, the July 2017 notice labeled “Kohl’s Department Stores, Inc.” as a “creditor” and listed “Capital One, N.A.” as the “original creditor” but failed to identify any entity as the “current creditor.” The lawsuit argues that “[m]ere illusions are not enough,” adding that the defendant was required to “specifically and clearly state who the creditor is” as mandated by the Fair Debt Collection Practices Act.
