The 23-page complaint says that although DreamBone Dream Kabobz are labeled as “made with real chicken, pork & duck,” the product’s more prominent ingredients include “antimicrobial humectant[s],” such as glycerin and sorbitol, a sugar substitute, and “binding agents.”
“Thus, the Product is a far cry from the quality product made predominantly with real meat and wholesome vegetables,” the lawsuit says.
According to the suit, consumers have relied on Spectrum Brands Pet’s deceptive product labeling to their detriment and would not have bought the rawhide-free chews, or would have paid much less for them, had they known real meat and vegetables were not the predominant ingredients.
Per the case, Spectrum Brands Pet promises in its marketing to “never compromise on quality” and to deliver healthy products containing quality ingredients. The filing says that the claim “made with real chicken, pork & duck” is accompanied on product packaging by images of the meats, leading reasonable consumers to believe they are buying a pet item made primarily from meat.
As the case tells it, the presence of glycerin and sorbitol in the DreamBone Kabobz in particular “evoke[s] concern for pet owners” given that the former is a “byproduct of soap and biodiesel production,” while the latter is a preservative, sugar substitute and oral/rectal laxative. The filing says Spectrum Brands Pets attests to using glycerin and sorbitol as mold inhibitors.
The lawsuit accuses the DreamBone Kabobz manufacturer of intentionally attempting to deceive consumers by representing that the products are made predominantly with meat, stressing that similar pet food products do contain meat as their primary ingredient.
“Because the Product is not predominately made with meat as reasonably expected by Plaintiff and other consumers, Defendant’s marketing of the Product was and continues to be misleading and deceptive,” the case reads.
The suit looks to cover consumers in California who bought DreamBone Dream Kabobz in the state within the applicable statute of limitations period.
