A New York consumer’s proposed class action against Debt Recovery Solutions, LLC and Pendrick Capital Partners II, LLC alleges the companies violated federal debt collection laws when they sent him a notice attempting to collect on a time-barred debt for which the statute of limitations had reportedly expired. According to the complaint, the defendants’ notice violated the Fair Debt Collection Practices Act (FDCPA) because at no point did the companies indicate to the plaintiff that no legal action could be taken to recover the debt. Making payment on a time-barred debt, the lawsuit notes, may restart its statute of limitations.
