Commonwealth Financial Systems, Inc. is facing a proposed class action filed by a consumer who claims the company misrepresented her debt dispute rights.

Commonwealth Financial Systems, Inc. is facing a proposed class action filed by a consumer who claims the company misrepresented her debt dispute rights.
The suit says the plaintiff received a collection notice in April 2018 directing the woman to “SEND ALL CORRESPONDENCE TO” the defendant’s mailing address. The case argues the letter falsely implied that the only option the plaintiff had to dispute the debt was to mail a written response when, in fact, she also had the right to dispute the obligation orally.
“Although the Defendant’s letter includes a telephone number, that number refers only to payments,” the complaint points out, arguing that this could lead the least sophisticated consumer to conclude that there is “no option” to dispute the debt over the phone.
