CertainTeed Corporation and Saint-Gobain Corporation are on the receiving end of a proposed class action that alleges their vinyl siding products contain a manufacturing defect that causes them to degrade when exposed to normal weather conditions. The seven named plaintiffs say they relied upon the defendants’ promises of durability, backed by a lifetime warranty, when they purchased siding for their homes. They noticed, however, that the siding had “blistered and degraded” prematurely, according to the complaint, and filed claims with the defendants to have the siding repaired or replaced. The defendants allegedly denied their claims without inspecting their homes, stating that the damage to the siding was caused by “heat distortion” from the reflection of nearby windows.
According to the suit, “it is a reasonable expectation of property owners” that the defendants’ siding would be “suitable” for homes or buildings that have windows. CertainTeed’s marketing and advertising, the plaintiffs argue, falsely assured them that the siding would be durable and would not contain a defect that caused it to blister and melt when exposed to normal conditions. Therefore, the complaint says, the plaintiffs are owed the money it will cost them to repair or replace the allegedly defective siding.
