A proposed class action filed back in August claims Central Credit Services LLC sent a New York consumer a collection notice in which it failed to clearly convey the amount of debt. Citing alleged Fair Debt Collection Practices Act (FDCPA) violations, the lawsuit claims the notice sent by the defendant said the stated “current balance” was subject to “timing and system limitations,” yet did not disclose to the plaintiff what these limitations were. The case argues this conduct could leave the plaintiff, i.e., the least sophisticated consumer, confused as to the true balance of his debt; if that balance may be different at the time payment is made; and how much is actually owed to satisfy the debt.
