Regan v. Arcadia Recovery Bureau, Llc
Filed: December 27, 2017 ◆§ 1:17cv7542
A consumer alleges Arcadia Recovery Bureau used unlawful, threatening tactics to pressure her into quickly paying off a debt.
New York
Arcadia Recovery Bureau, LLC is the defendant in a proposed class action in which the plaintiff claims the debt collector used unlawful, threatening tactics meant to pressure her into paying off her account quickly. The plaintiff alleges the defendant mailed her a collection letter in January 2017 that stated, “The balance due as of the date of this letter is stated above.” According to the complaint, the inclusion of such language violates the Fair Debt Collection Practices Act (FDCPA), as it falsely suggests the plaintiff’s account would be subject to change due to additional interest.
“Rather, upon information and belief, [the defendant] subtly pressed the least sophisticated consumer, in an attempt at pressuring [the plaintiff] into paying the account quickly, so as to avoid a threatened increase in the amount due,” the lawsuit claims.
