Lawsuit Claims American Sugar Refining Deceptively Claims Blue Agave Nectar is Organic

Ostensibly organic agave nectar is the subject of a proposed class action lawsuit filed against American Sugar Refining, Inc. in New York.
A New York woman has filed a proposed class action claiming defendant American Sugar Refining, Inc. misleadingly and deceptively advertises and sells its agave nectar as organic when in fact the company does not disclose that the product is “adulterated” with non-natural, non-organic ingredients. The 34-page complaint says that testing done on the defendant’s “organic” agave nectar, which retails under the Domino, C&H and Florida Crystals brand names, revealed the product contains isomaltose, an element not found naturally in pure agave syrup and commonly found in high fructose corn syrup.
“Consumers who purchase ‘organic’ agave syrup purchase it believing they are, in fact, receiving an organic product and also one free of non-natural, non-organic ingredients, which [the defendant] is secretly feeding them,” the lawsuit asserts. It goes on to claim that a reasonable consumer would not consider the product organic if he or she were aware it was allegedly adulterated with man-made ingredients.
