Aargon Collection Agency is on the receiving end of a proposed class action lawsuit that takes issue with a supposedly misleading debt collection letter the defendant sent to a California resident. According to the complaint, the letter noted that the plaintiff owed “$0.00” of “interest accrued” but later stated that “[b]ecause of interest that may vary from day to day the amount due on the day you pay may be greater.” The case claims this language is confusing to the least sophisticated consumer – and therefore violates federal debt collection law – because it falsely implies that interest may be added to the plaintiff’s account in the future.
“Upon information and belief,” the complaint surmises, “the amount allegedly due would never increase due to interest or other charges.”
