A proposed class action filed against Fiorella Insurance Agency Inc. claims the company violated the Telephone Consumer Protection Act (TCPA) by sending an unsolicited promotional text message to a Florida resident.
The plaintiff alleges that the defendant in October 2018 sent her an automated message in which it advertised health insurance plan offers. The suit says that “at no point in time” did the woman give the company her express consent to be contacted through an automatic telephone dialing system.
