Central Credit Services LLC is the defendant in a proposed class action filed by a New York consumer who claims she was deceived by a letter the debt collector sent her in January 2017. According to the suit, the letter misleadingly listed the plaintiff’s “CURRENT BALANCE” yet neglected to mention that the amount may increase due to interest or added fees.
“The Plaintiff was left uncertain as to whether the ‘CURRENT BALANCE’ was accruing interest as there was no disclosure that indicated otherwise,” the complaint reads.
The case points out that the woman’s balance was, in fact, increasing, as demonstrated by a later communication she received from another debt collector that listed a different debt amount for the same account. According to the lawsuit, the defendant’s letter would leave an unsophisticated consumer like the plaintiff unsure as to whether payment of the amount listed in the notice would satisfy his or her account.
