The CBE Group, Inc. is on the receiving end of a proposed class action lawsuit that claims the debt collector demanded an unlawful “collection fee” from a New York consumer.
The CBE Group, Inc. is on the receiving end of a proposed class action lawsuit that claims the debt collector demanded an unlawful “collection fee” from a New York consumer. The plaintiff says she received a collection letter from the defendant purporting that she owed $1,251.87 to Verizon and listing a $225.33 collection fee. According to the complaint, the plaintiff “was in the midst of a trial period” with Verizon and had canceled her account before any costs had incurred. “Therefore,” the complaint argues, “the balance and collection fee are fraudulent.” The suit further claims that the extra charge was “a predetermined percentage” of the total amount the defendant collected and could not legally be demanded before the plaintiff had made any payments on the alleged debt.
