A New Jersey consumer has filed a proposed class action in which she claims defendants Cavalry Portfolio Services, LLC and Apothaker Scian P.C. attempted to collect on her alleged debt without the required state licenses to do so.
The case focuses on three collection notices sent by the defendants in March 2017 and May and June 2018 in which the entities identified themselves as debt collectors. The suit says Cavalry Portfolio Services purchased the plaintiff’s obligation—originally owed to Citibank, N.A.—and obtained a judgment against the woman without first obtaining necessary authorization to operate as a debt collector in New Jersey, thereby making the defendants’ activities void and illegal.
Further, the suit adds that the March 2017 letter did not properly disclose the plaintiff’s rights in that it failed to explain that any dispute must be made in writing in order to obtain verification of the obligation.
