Caliber Home Loans, Inc. is facing a proposed class action lawsuit filed in Florida by a consumer who claims the defendant unlawfully attempted to collect on a mortgage loan for which he was no longer liable.
Caliber Home Loans, Inc. is facing a proposed class action lawsuit filed in Florida by a consumer who claims the defendant unlawfully attempted to collect on a mortgage loan for which he was no longer liable. The suit argues that Caliber’s alleged noncompliance with the federal Real Estate Settlement Procedures Act and the Florida Consumer Collection Practices Act subjected the plaintiff to “severe harm.”
According to the complaint, JPMorgan filed a Verified Complaint to Foreclose Mortgage against the plaintiff, which resulted in a final judgment declaring that he owed $123,836.94. JPMorgan allegedly hired Caliber Home Loans to service the mortgage and collect payments from the plaintiff. The complaint says he paid off the total amount owed on June 22, 2015.
The suit alleges, however, that Caliber continued to send the plaintiff letters attempting to collect on the mortgage and reported inaccurate information about him to credit reporting agencies “despite having actual knowledge and notice” that the plaintiff no longer owed the debt.
The plaintiff further claims that Caliber unlawfully sent communication directly to him after learning that he was represented by an attorney.
