New York
BBX Sweet Holdings, LLC and It’Sugar, LLC are on the receiving end of a proposed class action lawsuit that claims they discriminate against blind internet users by failing to make their website compatible with screen-reading technology. The defendants allegedly operate a chain of It’sugar stores and offer, through their website, access to information about store hours, locations, and products, as well as the ability to purchase gift cards and make reservations. The site, however, contains various access barriers, according to the suit, that block blind users from being able to fully navigate and interpret its content. From the complaint:
“These barriers are pervasive and include, but are not limited to: lack of alt-text on graphics, inaccessible drop-down menus, the lack of navigation links, the lack of adequate prompting and labeling, the denial of keyboard access, empty links that contain no text, redundant links where adjacent links go to the same URL address, and the requirement that transactions be performed solely with a mouse.”
