Four companies that operate Brooklyn’s Barclays Center have been named as defendants in a proposed class action lawsuit that claims they unlawfully deny employment based on background checks without first providing applicants a copy of their consumer reports, their rights under state and federal law, and an opportunity to dispute or explain the information contained in their reports. The plaintiff says he applied for a position at Barclays Center and had been offered the job, pending a background check. The day before he was to begin orientation, he allegedly received an e-mail from the defendants informing him that he had been denied the position based on information provided by a consumer reporting agency, which he later discovered was a criminal conviction from 2011. The suit claims that the defendants were required under state and federal law to provide the plaintiff with a copy of his report and his rights before taking adverse action against him. According to the suit, the defendants discriminated against prospective employees with purported criminal records by denying them an opportunity to correct any inaccuracies, explain their convictions, or display evidence of rehabilitation.
