Asset Recovery Solutions is facing a proposed class action claiming it violated the Fair Debt Collection Practices Act (FDCPA) by sending an improper collection notice to a New York consumer.
The plaintiff claims to have received a letter from the debt collector in April 2018 that failed to properly disclose his debt validation rights under the FDCPA. Specifically, the case alleges the defendant did not include in the notice required information concerning the plaintiff’s right to dispute the alleged obligation, obtain verification of the debt, or request the name and address of the original creditor.
