AR Resources, Inc. is the defendant in a proposed class action lawsuit that alleges the debt collector violated the federal Fair Debt Collection Practices Act (FDCPA) by failing to clearly identify a consumer’s creditor. The plaintiff says she received a collection letter from the defendant that stated, “Please be advised, our client, BERGEN COMMUNITY COLLEGE, has referred your account to us for collection.” The suit argues that this statement fails to comply with the FDCPA’s requirement that debt collectors “specifically and clearly” identify consumers’ creditors because it refers to Bergen Community College as a “client,” which the suit says is a “mere allusion to the creditor’s identity.”
