Alltran Financial, LP is facing a proposed class action lawsuit filed by a New York consumer who claims the defendant unlawfully interfered with his right to dispute an alleged debt.
Alltran Financial, LP is facing a proposed class action lawsuit filed by a New York consumer who claims the defendant unlawfully interfered with his right to dispute an alleged debt. The complaint alleges Alltran contacted the plaintiff attempting to collect on a debt purportedly owed to Vivint. Over the phone, the plaintiff’s representative allegedly informed the defendant that the man intended to dispute the debt, only to be told that the plaintiff must provide a reason for the dispute, the complaint says. The case argues that under the Fair Debt Collection Practices Act, consumers are not required to provide “a valid reason or to submit particular types of documentation” in order to dispute a debt.
