CMRE Financial Services, Inc. is facing a Florida consumer’s lawsuit that accuses the debt collector of misleading the man as to the amount of his debt.

CMRE Financial Services, Inc. is facing a Florida consumer’s lawsuit that accuses the debt collector of violating the Fair Debt Collection Practices Act (FDCPA) by misleading the man as to the amount of his debt.
The case takes issue with the defendant’s website, to which the plaintiff was allegedly directed in a November 2017 collection notice sent by the company. The website supposedly stated:
“Your account balance may be periodically increased due to the addition of accrued interest or other charges as provided in the agreement with the original creditor or as otherwise provided by state law.”
This statement misled the plaintiff as interest and fees were not, in fact, accruing on the obligation, the suit argues. Therefore, the complaint alleges, by stating the account balance “may” increase, the defendant failed to clearly convey the amount of debt and didn’t allow the plaintiff “to determine what he or she will need to pay to resolve the debt at any given moment in the future.”
