A proposed class action alleges that FCA US LLC sent a telemarketing text message to a Florida consumer without obtaining his prior express consent.
FCA US LLC is on the receiving end of a proposed class action that alleges the company sent a telemarketing text message to a Florida consumer without obtaining his prior express consent as required by the Telephone Consumer Protection Act (TCPA).
According to the complaint, the defendant – better known as automaker Fiat Chrysler – sent the consumer an unsolicited text message promoting its “all new 2019 Ram 1500” truck in July 2018. The suit argues that the defendant “knew or should have known” that contacting the plaintiff without his consent violates the TCPA. As such, the case seeks statutory damages and injunctive relief prohibiting the defendant from sending non-TCPA-compliant text messages in the future.
