A Kansas man claims Aetna unlawfully exposed his sensitive personal health information by mailing medical records in an 'open window' envelope.

A Plainville, Kansas resident on October 12 filed a proposed class action against Aetna Health, Inc., its life insurance division, and Aetna, Inc. that alleges the companies violated his privacy by unlawfully disclosing information pertaining to his HIV diagnosis by mailing medical records in an “open window” envelope. The lawsuit describes the defendants’ alleged violation of the plaintiff’s privacy rights as “outrageous” and having resulted in “extreme and severe mental distress.”
“[The defendants] breached their duty to keep [the plaintiff’s] medical information private by publicizing matters of a highly sensitive nature to the public concerning the private life and medical information of [the plaintiff],” the case reads.
