Lawsuit Against Transworld Systems Takes Issue with Glue Used to Seal Collection Notice

A lawsuit claims the gumming agent Transworld Systems uses on folded self-mailer notices obscures essential debt information when the letters are opened.
A proposed class action filed by two plaintiffs alleges Transworld Systems, Inc. mailed them collection notices in which the company committed several violations of the Fair Debt Collection Practices Act (FDCPA).
The first plaintiff alleges the letter she received from Transworld Systems was a “folded self-mailer” that did not come in a standard envelope and was sealed using a gumming agent. The lawsuit claims that when the plaintiff opened this self-mailer notice, she could not read the “CURRENT BALANCE DUE” because the gumming agent used to seal the notice made this information impossible to read once the communication was torn open (pictures of this are provided in the complaint below).
“As a result of the coincident placement of this information and the gumming agent with [the notice], it became impossible to determine the amount that was due once the letter was opened because this information was attached to the gumming agent when it became separated from the face of the letter,” the complaint reads, alleging this was a deliberate tactic used by the defendant to induce debtors to call the company.
Per the second plaintiff, the lawsuit claims the individual received a collection notice from Transworld Systems that put forth three payment options that could ostensibly resolve the debt, yet included language that states interest and other charges “may be periodically added to the account balance.” The case argues that the payment options presented to this plaintiff make it unclear if any would actually resolve the debt in full.
