Vayngurt v. Professional Claims Bureau, Inc.
Filed: January 31, 2018 ◆§ 1:18cv699
A proposed class action lawsuit has been filed against Professional Claims Bureau, Inc. by a New York woman who claims the defendant violated her rights under the Fair Debt Collection Practices Act.
New York
A proposed class action lawsuit has been filed against Professional Claims Bureau, Inc. by a New York woman who claims the defendant violated her rights under the Fair Debt Collection Practices Act (FDCPA). The plaintiff says she received a letter from the debt collector that referenced both “Mount Sinai Beth Israel Hospital” and the defendant’s name without identifying either entity – or any other entity – as the creditor to whom the alleged debt was owed, as required by the FDCPA.
The complaint further argues that the defendant failed to include a disclosure in the letter that informed the plaintiff of her right to dispute the debt or request validation.
On top of that, the suit claims the letter was addressed to an unknown person – an incorrect name that combined the plaintiff’s last name with her son’s first name – further confusing the plaintiff.
