Advanced Care Scripts, Inc. has been accused in a proposed class action of unlawfully obtaining background reports on prospective and current employees without authorization.
Advanced Care Scripts, Inc. has been accused in a proposed class action of unlawfully obtaining background reports on prospective and current employees without authorization in violation of the Fair Credit Reporting Act (FCRA). The plaintiff claims she was hired by the defendant in November 2016 after the company obtained a background report on her through a third-party. In January 2018, the company allegedly informed the woman that it would be conducting “a more extensive background check” but, according to the complaint, never obtained additional authorization from her to do so. The plaintiff says she never agreed to allow the defendant to obtain “unlimited consumer reports” about her and argues that the second report was unlawful under the FCRA.
