Melnikov v MRS BPO LLC
Filed: October 15, 2018 ◆§ 1:18-cv-05758
MRS BPO is the defendant in a proposed class action filed by a consumer who claims the company made false representations in its debt collection efforts.
MRS BPO, LLC is on the receiving end of a proposed class action filed by a New York consumer who claims the company made false representations in its debt collection efforts.
The suit focuses on a November 2017 notice allegedly sent by the defendant regarding the plaintiff’s account with Chase Bank. According to the complaint, the letter stated, in part:
“If we settle this debt with you for less than the full outstanding balance, Chase may offer you less favorable terms in the future for some Chase products or services, or may deny your application.”
The case argues the company falsely implied that paying the alleged debt in full would be more beneficial to the plaintiff than accepting the settlement offer.
“On information and belief, Plaintiff’s payment in full of the amount claimed would not have enhanced [his] likelihood of obtaining Chase credit products or services in the future, nor would it have improved [his] overall creditworthiness,” the suit says.
