A proposed class action accuses Alpha Recovery Corp. of sending an unlawful debt collection notice that failed to clearly convey the amount of a consumer’s debt.
A proposed class action out of New York federal court accuses Alpha Recovery Corp. of sending an unlawful debt collection notice that failed to clearly convey the actual amount of a consumer’s debt.
The defendant allegedly sent the plaintiff a letter in January 2018 that identified a “current balance claimed due,” which left the woman unsure as to whether the “current” balance would increase, the case argues. From the complaint:
“While it is typical for collection letters to state an ‘amount due’ or a [sic] ‘account balance,’ it is not typical for a letter to state that the amount owed is as of a specific date as such language would imply the potential of a different balance on a different date.”
In sum, the suit argues that the letter violated the Fair Debt Collection Practices Act by misrepresenting the amount of debt owed by the plaintiff.
