A consumer alleges that The Law Offices of Robert A. Schuerger falsely implied it was acting in a legal capacity instead of solely as a debt collector.

A proposed class action claims The Law Offices of Robert A. Schuerger sent a collection notice that falsely implied it was acting in a legal capacity instead of solely as a debt collector.
Behind the case is a Philadelphia consumer who says he received a letter from the defendant in October 2018 concerning a debt owed to Arcadia University. The suit claims the notice, which identified the defendant as a law firm in its letterhead, misled the plaintiff in that no attorney employed by the Ohio-based firm was licensed to practice in Pennsylvania. The letter caused the man to believe he was subject to legal action, the complaint says, as the defendant failed to state that it was not acting as an attorney and that no attorney had reviewed the plaintiff’s account before the letter was sent.
Moreover, the suit takes issue with the plaintiff’s reference number being visible through the window of the letter’s envelope. The case argues that the number “constitutes personal identifying information” and could have harmed the plaintiff by being publicly displayed.
