A proposed class action has been filed against the Law Offices of Hayt, Hayt & Landau, LLC claiming the debt collector demanded an amount that was more than a consumer actually owed.

A proposed class action has been filed against the Law Offices of Hayt, Hayt & Landau, LLC claiming the debt collector demanded an amount that was more than a consumer actually owed. The plaintiff says the defendant filed a lawsuit against him claiming he owed an unpaid balance of $4,022.74 and separately listing “costs” of $171.50. The suit argues that the actual balance of the plaintiff’s debt was $3,851.24 and that the extra costs were already included in the $4,022.74 amount.
“As such,” the complaint attests, “[the defendant] was illegally attempting to collect the costs twice from the Plaintiff” and added extra charges to the debt “that it was not legally allowed to collect.”
