The law firm and its namesake are the defendants in a lawsuit claiming it unlawfully threatened thousands of consumers through collection notices.

The Law Offices of David R. Jordan, P.C. and the firm’s namesake are the defendants in a proposed class action filed over potential violations of the Fair Debt Collection Practices Act (FDCPA). Filed in New Mexico, the lawsuit alleges the defendants have sent thousands of debt collection letters to consumers on behalf of Cash Cow, a company the case calls a “Gallup predatory lender.” According to the suit, the letters all threatened that the individual defendant was “preparing to initiate a lawsuit” against each recipient. The problem?
“The letters were lies,” the lawsuit argues. “[Defendant David R. Jordan] had no meaningful involvement in sending the letters, and had made no preparation to bring suit against the recipients.”
The plaintiff claims the letter he received from the defendants in October 2016 was meant to give the false impression that the law firm had reviewed his Cash Cow loan file and that he was a candidate for legal action. In truth, the case says, the defendants did not review any of the plaintiff’s files and obtained “absolutely no information whatsoever” about the man before sending him a collection notice.
